Terms of Use

Interim — preview / beta

These interim terms are published for the Kinsly preview. They are not legal advice and are not final. Kinsly’s legal operating entity is being established; until it is named, “Kinsly” means the operator of this service.

1. Agreement

By creating a Kinsly account or using the Kinsly apps or website you agree to these terms. If you do not agree, do not use Kinsly. Our Privacy Notice explains how we handle information.

2. Eligibility and territory

You must be at least 18 years old to hold a Kinsly account. Kinsly is currently offered in Canada and the United States only. You are responsible for complying with the laws that apply where you use the service.

3. Accounts

Provide accurate details, keep your credentials secure, and tell us promptly if you suspect unauthorised access. You are responsible for activity on your account. Do not share your account with someone else — invite them as a Trusted Contact instead.

4. Roles: Supported Members and Trusted Contacts

  • A Supported Member receives Guided Assistance and needs an active Kinsly Connect subscription (their own, or one sponsored for them).
  • A Trusted Contact gives Guided Assistance and uses Kinsly free of charge. A Trusted Contact must be approved by the Supported Member and can be removed at any time.
  • Trusted Contacts must act in the Supported Member’s interest, must not pressure anyone into sharing a screen, and must not use what they see for any other purpose.

5. Consent-based Guided Assistance — no remote takeover

A session only begins when the Supported Member starts or accepts it, and screen sharing only begins when the Supported Member chooses what to share. Kinsly does not provide remote control: a Trusted Contact cannot move the cursor, type, install software or operate the Supported Member’s device. Guidance is limited to voice and on-screen highlighting. The Supported Member can enable Privacy Mode or end the session at any moment.

6. Acceptable use

  • Do not use Kinsly to access an account or device you are not authorised to see.
  • Do not coerce, defraud, or financially exploit another person.
  • Do not record, capture or redistribute a session without the other person’s agreement.
  • Do not use Kinsly to provide commercial IT services unless we agree in writing.
  • Do not attempt to breach, probe or overload the service.

7. Subscriptions, renewal and cancellation

  • Kinsly Connect is US$9.99 per month per Supported Member, plus applicable taxes.
  • Kinsly Guardian is US$14.99 per month per Supported Member, plus applicable taxes, and includes everything in Connect.
  • Subscriptions renew automatically each month until cancelled, and the payment method on file is charged on each renewal date.
  • You may cancel at any time from Account → Subscription. Cancellation takes effect at the end of the current billing period; access continues until then.
  • Payments are not prorated and not refunded for partial periods, except where a refund is required by applicable law.
  • Upgrades and downgrades. Moving between Connect and Guardian changes your subscription with your payment provider; upgrades take effect immediately and downgrades follow the provider’s standard proration behaviour.
  • Sponsorship. If you sponsor someone’s subscription you are the payer and can cancel it; the Supported Member loses the ability to receive help when the paid period ends.
  • Prices may change. We will give notice before a change applies to your renewal.
  • Payments are processed by our payment provider. During the preview, checkout may run in test mode; test-mode transactions are not real charges.

8. Kinsly Guardian

Guardian is user-initiated decision support. It reviews only the screenshots, pasted or typed text and links that you choose to submit as a Guardian check. It does not monitor your screen, messages, inbox, calls or accounts, and it does not run in the background.

  • Guardian includes 100 submitted checks per calendar month (UTC). The allowance resets at the start of each calendar month and unused checks do not carry over.
  • A check may combine text extraction from images, automated heuristics, AI analysis and link-reputation lookups. If one of those steps is unavailable, Guardian may return a partial review and will say which steps did not run.
  • A result is an opinion, not a verdict. A low-risk result does not mean something is safe, and Guardian may not identify every scam or threat. It does not replace your judgment or professional cybersecurity, legal or financial advice.
  • You may share a Guardian check with a Trusted Contact. Sharing is explicit and you can revoke it at any time. You may also delete a check and its evidence.

Session Safeguard session recording is not available today and is not part of what Connect or Guardian provides. Anything described as future or planned is a statement of intent, not a commitment to ship on any date or at any price, and you should not subscribe in reliance on it.

9. Artificial intelligence

Kinsly does not use AI to analyse your screen, audio or personal data during a Support Session. AI is used only inside a Guardian check, on the content you voluntarily submit, to help extract text from images and to describe why something looks suspicious. Any AI output is informational only and is subject to the Guardian limitations above.

10. Content you submit

You keep ownership of what you submit — notes, Saved Fixes, screenshots and similar. You grant Kinsly the limited licence needed to store, transmit and display that content to run the service for you and the people you have approved. Do not submit content you do not have the right to share.

11. Availability and platform limitations

  • Kinsly is in active development and may change, break or be unavailable.
  • Supported Members cannot receive Guided Assistance through the web portal and must use a supported native Kinsly app (macOS and Windows today).
  • Trusted Contacts may join and guide from a supported desktop browser or from the Kinsly desktop app.
  • iPhone and Android apps are planned and are not yet available for download.
  • Sessions depend on your internet connection, device and operating-system permissions.

12. Not an emergency or professional service

Kinsly is not an emergency service and must not be used to contact emergency responders. Kinsly is not a bank, security firm, legal advisor or licensed IT contractor, and help given by a Trusted Contact is not professional advice. If you believe you are the victim of fraud, contact your bank and local authorities.

13. Disclaimers

To the maximum extent permitted by law, Kinsly is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free, or that any problem a Trusted Contact tries to solve will be solved. Nothing in these terms limits rights you have under consumer protection law that cannot be limited.

14. Limitation of liability

To the maximum extent permitted by law, Kinsly is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or the acts of another user including a Trusted Contact. Where liability cannot be excluded, our total liability is limited to the amount you paid Kinsly in the twelve months before the claim, to the extent that limit is permitted where you live. The final liability provisions are being settled alongside the operating entity and governing law below, and these interim preview terms will be updated when they are.

15. Suspension and termination

You may stop using Kinsly and close your account at any time. We may suspend or terminate an account that breaches these terms, creates risk to another person, or is used unlawfully. Sections that by their nature should survive termination will survive.

16. Changes to these terms

We may update these terms as the product develops. The effective date and version above will change, and material changes will be communicated in-app or by email. Continuing to use Kinsly after an update means you accept it.

17. Governing law and contact

Kinsly's operating entity, registered address, governing law and jurisdiction are being finalised. These interim preview terms will be replaced with the finalised provisions before general availability, and we will not assert a governing law or forum that is not stated here.
